APPLICATION TO MODEFREEFINDS SWEEPSTAKES: These Official Rules apply to prize giveaways sponsored by Mode Mobile, LLC, a Delaware limited liability company (the “Sponsor” or “Mode”), conducted through the Free Finds website or associated entry pages (each, a “Sweepstakes”). Participation in any Sweepstakes constitutes the entrant’s full and unconditional agreement to, and acceptance of, these Official Rules and forms a binding contract between Mode and the entrant.
SWEEPSTAKES PERIOD:
Each Sweepstakes begins and ends at the times and dates set forth on the applicable giveaway entry page on the Free Finds website (the “Sweepstakes Period”). Unless otherwise specified, entries for a Sweepstakes are accepted starting at 12:00:01 A.M. CST and will not be accepted after 11:59:59 P.M. CST on the dates indicated on that entry page.
ELIGIBILITY:
(a) Contestants.
Persons in any of the following categories are NOT eligible to participate in or win prizes in any Sweepstakes:
(a) any director, officer, employee, agent, or independent contractor of Mode Mobile, LLC (“Mode”), its parent company, subsidiaries, affiliates, or service agencies, or any entities retained by such persons for the administration of the Sweepstakes;
(b) any individual involved in the development, production, or distribution of Sweepstakes materials or the prize supply; and
(c) any immediate family member (defined as spouse, IRS dependent, or biological, adoptive, or stepmother, father, sister, brother, daughter, or son, and each of their respective spouses) of, or any person residing in the same household as, any person in the preceding categories.
(b) Residency Requirements.
Each Sweepstakes is open only to legal residents of the United States and the District of Columbia, excluding Florida, and is void in all countries on the United States’ list of embargoed countries found here, as well as the following jurisdictions:
Afghanistan, Argentina, Australia, Bahamas, Belgium, Belize, Bolivia, Brazil, the province of Quebec (Canada), Cambodia, Chad, China, Colombia, Croatia, Cuba, Dominican Republic, Ecuador, Egypt, El Salvador, Ghana, Guatemala, Guinea, Haiti, Honduras, Hong Kong, India, Iran, Iraq, Israel, Italy, Jamaica, Lebanon, Luxembourg, Malaysia, Mali, Myanmar, Nicaragua, North Korea, Pakistan, Panama, Peru, Poland, Portugal, Russia, Singapore, Somalia, Spain, Sudan, Sweden, Syria, Tanzania, Thailand, Trinidad and Tobago, Tunisia, Turkey, Uganda, Ukraine, Venezuela, Yemen, Zimbabwe, and any other jurisdiction where local laws would prohibit entry into or delivery of a prize for a Sweepstakes.
(c) Prize Restrictions.
Certain jurisdictions may permit entry into a Sweepstakes but prohibit the receipt of a prize. It is the entrant’s responsibility to review and comply with any applicable local restrictions prior to entering. Mode is not obligated to deliver a prize or allow entry if doing so would violate any applicable law or regulation.
HOW TO ENTER:
To enter a Sweepstakes via the Free Finds website (the “Website”), an eligible participant must complete and submit the entry form provided on the applicable giveaway entry page during the Sweepstakes Period. All required fields on the entry form must be completed for an entry to be valid.
Once submitted, an entry cannot be deleted, canceled, or modified. Limit one (1) entry per person per Sweepstakes, unless otherwise stated on the entry page.
Any attempt to obtain more than the stated number of entries by using multiple identities, email addresses, accounts, or any automated means will void all associated entries and may result in disqualification.
SWEEPSTAKES PRIZES:
For each Sweepstakes, the prize awarded will be the item or items described on the applicable giveaway entry page on the Free Finds website (the “Prize”). The approximate retail value (“ARV”) of the Prize will also be stated on that entry page.
Unless otherwise specified, only one (1) winner will be selected per Sweepstakes, and only one (1) Prize will be awarded. Prizes are non-transferable and may not be substituted, except at the sole discretion of the Sponsor.
The odds of winning a Prize depend on the total number of eligible entries received during the applicable Sweepstakes Period.
DRAWINGS AND NOTIFICATIONS:
A random drawing will be conducted by the Sponsor from all eligible entries received during the applicable Sweepstakes Period to determine the winner (the “Sweepstakes Winner”). The drawing will occur within a reasonable time after the close of the Sweepstakes Period.
The Sweepstakes Winner will be notified by email using the email address provided at the time of entry. Sponsor’s decisions regarding the selection of the winner and all matters related to the Sweepstakes are final and binding.
The odds of winning a Prize depend on the total number of eligible entries received during the Sweepstakes Period. If a potential winner cannot be reached, fails to respond within three (3) calendar days, is found to be ineligible, or otherwise fails to comply with these Official Rules, the Prize may be forfeited and an alternate winner may be selected.
PRIZE VERIFICATION & CONDITIONS:
The selected Sweepstakes Winner is subject to verification of eligibility and compliance with these Official Rules before being confirmed as the official winner. Sponsor may require the potential winner to provide additional information or documentation as reasonably necessary for verification.
If the Prize or prize notification is returned as undeliverable, if the potential winner fails to respond within the required timeframe, or if the potential winner is determined to be ineligible for any reason, the Prize may be forfeited and an alternate winner may be selected.
Prizes will be delivered by the Sponsor within ninety (90) days following the end of the Sweepstakes Period, unless otherwise specified on the entry page. Prizes are non-transferable, and no substitution is permitted except at the sole discretion of the Sponsor.
GENERAL CONDITIONS:
By accepting a Prize, and where permitted by law, the winner grants to the Sponsor, its parent companies, subsidiaries, affiliates, and those acting under Sponsor’s authority (and may be required to confirm such grant in writing upon Sponsor’s request), the right to print, publish, broadcast, and use worldwide, in any media now known or hereafter developed, the winner’s full name, portrait, picture, voice, likeness, and biographical information for advertising, trade, and promotional purposes without additional compensation, approval, or notification.
IN NO EVENT WILL THE SPONSOR, ITS PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, ADVERTISING AND PROMOTION AGENCIES, DEALERS, DISTRIBUTORS, SUPPLIERS, PRIZE PROVIDERS, OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES, OR AGENTS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF OR RELATED TO PARTICIPATION IN THE SWEEPSTAKES, OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, THE PRIZE.
RELEASE:
By participating, entrants agree to release and hold harmless the Sponsor, its parent companies, affiliates, subsidiaries, advertising and promotion agencies, dealers, distributors, suppliers, and their respective directors, officers, employees, representatives, and agents from any and all liability for injuries, death, losses, or damages to persons or property, as well as any claims or actions based on publicity rights, defamation, and/or invasion of privacy, arising out of participation in the Sweepstakes or any related activities, or the acceptance, possession, use, or misuse of the Prize. Winners acknowledge that the Sponsor has neither made nor is responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the Prize.
INTERNET LIMITATIONS OF LIABILITY:
If for any reason a Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify, or suspend the Sweepstakes in whole or in part, at any time, without notice. If terminated, Sponsor may, at its discretion, award the Prize from among all non-suspect eligible entries received up to the time of termination.
Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers; computer equipment; software; failure of any email or entry to be received by Sponsor due to technical problems, human error, or traffic congestion on the Internet or at any website; or any combination thereof, including any injury or damage to participants’ or any other person’s computer related to or resulting from participation in the Sweepstakes or downloading any materials associated with the Sweepstakes.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) TO THE FULLEST EXTENT PERMITTED BY LAW.
In the event of a dispute as to the identity of an entrant based on an email address, the eligible entry will be deemed to have been submitted by the authorized account holder of the email address at the time of entry. The “authorized account holder” is defined as the natural person assigned to an email address by an internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.
USE OF DATA: All information submitted by entrants will be treated in accordance with the Sponsor’s Privacy Policy, available at https://modemobile.com/. By participating in a Sweepstakes and providing your email address and/or phone number, you agree to the Sponsor’s collection, use, and disclosure of your personal information for the purposes of administering the Sweepstakes and communicating with entrants, and you acknowledge that you have read and accepted the Sponsor’s Privacy Policy.
DISPUTES: Except where prohibited, you agree that any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Illinois. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes shall be governed by, and construed in accordance with, the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules that would cause the laws of any other jurisdiction to apply.
TRANSFER: The transfer, assignment, or substitution of a winner’s status or Prize is strictly prohibited, except at the sole discretion of the Sponsor.
WINNER LIST: A winner list for a Sweepstakes may be requested by contacting Mode at [email protected] with the subject line “Request for ModeFreeFinds Sweepstakes Winner List.” Winner lists will include only the following information: (i) first name, (ii) last initial, and (iii) city and state (or country) of residence.
