General Automobile Insurance – Uninsured, Underinsured Motorist Benefits Class Action Settlement

The General Automobile Insurance – Uninsured and Underinsured Motorist Benefits Class Action Settlement alleges that The General Insurance, through Permanent General Assurance Corporation and related companies, unfairly denied or reduced certain vehicle claims in Tennessee. According to the lawsuit, the company failed to fully pay “loss-of-use” damages when policyholders’ cars were declared total losses. “Loss of use” refers to the time you were unable to use your vehicle before getting a replacement. The insurance company has denied doing anything wrong but agreed to a settlement to resolve the dispute.

Who Qualifies for a Payout in This Settlement?
You may be eligible to receive money from this settlement if all of the following apply:

  • You had auto insurance from Permanent General Assurance Corporation, Permanent General Assurance Corporation of Ohio, or The General Automobile Insurance Company, Inc.
  • Your policy was issued in Tennessee and covered vehicle damage.
  • Between October 5, 2015, and January 31, 2022, your car was involved in an accident and declared a total loss.
  • You filed a claim and did not receive payment for the time you were without a usable car (“loss of use”).

This settlement only applies to claims in Tennessee during the dates listed above.

Is It Necessary to Provide Proof?
If you’re already included on the list of eligible claimants maintained by the insurance companies, you don’t need to submit any additional documentation to file a claim. Most eligible people should have received a notice by mail or email. If you didn’t receive a notice but believe you qualify, you can still file a claim. However, in that case, you may be asked to provide some proof to confirm your eligibility.

What Amount Can I Receive from This Settlement?
The exact amount of compensation depends on how many people submit valid claims. While the final payout hasn’t been set, the settlement is meant to reimburse eligible policyholders for the “loss of use” damages they should have received when their vehicle was totaled. Payments will be divided fairly among approved claimants based on how many valid claims are submitted.
