Whirlpool, KitchenAid, Maytag Frost Issues Class Action

This deadline has passed, but here’s another class action for you.

A class action settlement has been reached regarding certain Whirlpool-manufactured refrigerators, including specific models under the Whirlpool, KitchenAid, JennAir, and Maytag brands. The lawsuit alleges that these refrigerators suffer from a defect in their defrost heating system, which may cause excessive frost and ice accumulation on the evaporator within the refrigeration compartment. This issue can interfere with the refrigerator’s ability to maintain proper cooling, potentially leading to food spoilage and other inconveniences for owners.

This settlement provides eligible consumers with compensation for out-of-pocket expenses incurred due to this defect.

Who Qualifies for a Payout in This Settlement?

The settlement covers all individuals in the United States and its territories who, between 2012 and 2019, either:

  • Purchased a new qualifying refrigerator,
  • Acquired a qualifying refrigerator as part of a home purchase or remodel, or
  • Received a qualifying refrigerator as a gift from Whirlpool Corporation or an authorized reseller.

To be considered a qualifying refrigerator, the model must be a three-door, bottom-mount, French door unit equipped with a dual evaporator cooling system. Consumers are encouraged to check the list of all qualifying models to confirm their eligibility.

Is It Necessary to Provide Proof (or Proof of Purchase)?

Yes, claimants must submit proof of purchase to qualify for reimbursement. Additionally, they must provide documentation of any out-of-pocket expenses incurred due to repairs or replacements related to the alleged defect. Acceptable forms of documentation include:

  • Receipts for repair services
  • Invoices detailing the nature of the repair
  • Proof of payment for the repair or replacement
  • Any other relevant documents supporting the claim
What Amount Can I Receive from This Settlement?

The settlement offers cash reimbursements for documented, out-of-pocket expenses incurred for repairing or replacing a qualifying refrigerator’s evaporator due to frost clog issues within eight years of the product’s manufacture date. The reimbursement amounts are structured as follows:

  • Up to $300 per qualifying repair within three years of the refrigerator’s manufacture date.
  • Up to $225 for repairs conducted within four to six years of manufacture.
  • Up to $150 for repairs within seven to eight years of manufacture.
